Terms of Service

1. Acceptance

By accessing and using the AdsOptimize platform (the "Platform"), you fully accept these Terms of Service and the accompanying Privacy Policy. If you do not accept these terms, please do not use the Platform.

2. Description of Service

AdsOptimize is a SaaS platform that enables small and medium-sized businesses to create, publish, and optimize Meta (Facebook/Instagram) and TikTok ad campaigns with AI assistance. Users authorize their respective advertising accounts via OAuth, have their websites analyzed by AI, receive recommendations for campaign / ad set / ad configurations, upload their own creative assets, and publish campaigns to Meta or TikTok.

3. Eligibility

To use the Platform, you must be at least 18 years old and have the authority to publish ads on the advertising accounts you connect. You may not gain unauthorized access to a third party's advertising account.

4. Account & Security

• •You are responsible for the security of your account credentials (username, password, OAuth tokens).
• •You are responsible for all activity that occurs under your account unless it can be clearly attributed to another party.
• •If you detect unauthorized access, you must notify us immediately at info@adsoptimize.ai.

5. Subscription, Payments, and Refunds

• •Subscription fees corresponding to your chosen plan (monthly, enterprise, etc.) are charged via PayTR, Iyzico, or Cryptomus.
• •Subscriptions automatically renew each billing period unless canceled.
• •You may cancel anytime from the Settings page; after cancellation, access continues until the end of the current billing period.
• •Where required by law, you may receive a full refund within 14 days of payment if the service has not been used.

6. Acceptable Use

You agree not to use the Platform in any manner that violates laws, third-party platform policies, or generally accepted standards. Specifically:

• •You must comply with the Meta Advertising Policies and the TikTok Advertising Policies.
• •You may not create misleading, fraudulent, or deceptive ads.
• •You may not upload content that infringes copyright, trademark, or other third-party rights.
• •You may not abuse the Platform's infrastructure via automated bots, scraping, or malicious software.
• •You may not engage in spam, harassment, discrimination, or promotion of illegal products/services.

7. Third-Party Platforms (Meta, TikTok)

Certain features of the Platform operate through the Meta Marketing API and the TikTok Marketing API. These platforms' terms of service, advertising policies, and decisions are independent and directly bind you. Any decision made by Meta or TikTok (ad rejection, account suspension, etc.) is not the responsibility of AdsOptimize; in such cases you must contact the relevant platform directly.

8. AI Recommendations

The Platform uses third-party AI services such as Google Gemini to generate campaign recommendations. These recommendations are informational only, and final responsibility lies with the user who publishes the campaign. AdsOptimize accepts no liability for advertising spend or outcomes resulting from AI suggestions.

9. Intellectual Property

The Platform and all software, brands, logos, and content it contains belong to AdsOptimize. Creative assets you upload (images, videos, text) remain your property; you grant AdsOptimize a limited, worldwide, royalty-free license solely to provide the service to you.

10. Limitation of Liability

AdsOptimize does not guarantee specific improvements in ad performance. The user is responsible for any advertising spend resulting from the application of AI recommendations. We cannot be held liable for damages caused by temporary Platform outages, third-party platform API outages, or force majeure events. In no event shall our total liability exceed the amount you have paid in subscription fees during the preceding 12 months.

11. Suspension and Termination

If we determine that you have violated these terms, we may suspend or permanently terminate your account. You may also close your account at any time. Upon termination, the data retention periods specified in our Privacy Policy apply.

12. Governing Law

These Terms of Service are governed by the laws of the Republic of Türkiye. Any disputes shall be resolved by the Istanbul Courts and Enforcement Offices.

13. Changes

These Terms of Service may be updated from time to time. Material changes will be notified at least 30 days in advance. Continued use of the Platform after the effective date constitutes acceptance of the updated terms.
